Now that we have our construction financing in place, we are gettinginquiries. A couple of people are ready to sign real estate contracts.One household wants a unit that another person has a contract on.

When a community is just beginning this really isn't the same as a private transaction because there will be a cascade of changes and people on waiting lists will then move in. People will always withdraw or change to a different unit midstream. If it is treated as a private transaction and this household only has a private contract, what do they do if they change their minds or the first household changes their mind?
I think it would be better to keep a waiting list -- people pay a non-refundable amount to get on the list. That establishes a choice order. The household in question might also want to take a contract on another unit in case these people don't move. With a waiting list, people can't bump someone else who has a contract on a unit but they get first choice of any unit that becomes available.
