I have acted in such capacity on a few occasions. What conventional attorneys wanted to know from me is, how is this legally different from a standard (condo, coop, etc.) and are there legal issues which are unique to this kind of living that should be considered. The primary thing which astounds them is that people investing in this lifestyle are willing to trust each other and work things out. Once an attorney understands this, they can craft the legal frameworks appropriately, but it is foreign to everything they do, so often it takes several examples before they consider cooperation a possibility at all. And deep down, I'm not sure they actually believe its possible, but that's OK. Having a defined litigation path is not really a problem, and residents are free to solve their issues in the manner that suits them, which seldom requires legal litigation. Occasionally things do break down in some places so having defined legal pathway is a good idea, and that boilerplate standard ones are time tested and work.
