I agree with Sharon, you need to double-check your deeds - just because the community sees the backyards as private doesn't mean they are legally. Even if they are, that homeowner would need likely a locked fence just like a pool owner would. Your biggest issue isn't going to be local ordinances - legality - it's going to be INSURANCE. We had a trampoline in the common area...and had to get rid of it because NO ONE would insure us. Not a single insurance company would renew our HOA liability insurance with that thing anywhere on the property. Eris FrogSong
