I find it very interesting (and more than a bit ironic) that you had to
take all references to cohousing out of your filings and take out the
requirement of signing a participation agreement in order to get your
mortgages, when the Boston Globe just ran a front page story last week on
covenants and how they are *very* enforceable in the case of property
rights. Case in point:the neighborhood in question had a covenant in
effect that said that everyone had to keep their lown mowed. One neighbor
let his yard get out of control, so the neighbors hired a gardener to do
the work and sent him the bill. According to the neighbors, they haven't
had a problem with him since. Odd how this "covenant" thing can be
enforced when it comes to keeping up property values but given short
shrift when it comes to more important things--such as sharing,
socializing, and cooperation.
