If the balconies are limited common elements and the courtyard is a common  
element, as is true here in Eastern Village, then you can ban smoking in all  
LCEs and CEs and the banks won't mind.  
 
Then you just have to plan the HVAC in the individual units so it is  
properly separated and smoke cannot cross from one unit to another.  And  get 
an 
expectation in place that folks who smoke will do so outside away from  the 
units, 
or in their own units with the doors and windows closed and a fan  on.
