We are in the process of revising our ByLaws given first set were written to satisfy needs of AG's office condo expectations as cohousing was a foreign breed in NH. The clause regarding what is called Alienation of Units stipulates that waiting list can be bypassed when there is a gift, sale, lease or devise of a Unit to an immediate family member of the Owner. While we recognize that an Owner should have the right to convey an asset to a family member as they wish, we are wondering if more experienced cohousing communities have had "issues" when immediate family members take ownership without having gone through a process of becoming familiar with cohousing, membership process, etc. Our sense is most often they sell the asset and move on.
