The business is a daycare. Village members would have unlimited access to the fenced-in area, but would have to be sure that belongings left in the area would be safe for young kids. There would be gates that some members would have to traverse to reach their units.

As far as this setting a precedent, our bylaws require that all owners sign off on such an arrangement, so each case would require its own discussion and decision. Also, the daycare would only be in operation for 3 years.

Without knowing the details that sounds like a show stopper to me. What happens when more prospective members show up with the same requirement?

One of our prospective new members currently has a business that they
would bring with them to the community were they to move in. This
business would require use of a large percentage of our outdoor
common space for up to 3 hours a day during business hours. The
business would also require installing a 4-foot fence to enclose that
space.

We are wondering if other communities have had experience with home
businesses that use common elements, and if so, how it all worked out.
