Cohousing-L Mailing List: Owner-business use of common space

I'm sure there's a very good reason for it, but why wouldn't the member fence 
in his or her own backyard (aka "rear LCE") for his or her daycare business, 
versus fencing off common land next to the CH?
 
We have a member in our community who runs a daycare out of his walk-out 
basement, but he uses his own backyard for the kids to play in.  This see
