A law suit of alleged defamation is cited on the www.davis-stirling.com
website whereby a board member felt he/she was defamed by a member claiming
that the Board member was incompetent. The case was decided in the
defendant's favor.
The interpretation is that, since all that happens between people within common interest developments is of a political nature, nobody can claim to have been defamed and have a judge agree. One can say anything about another community member with impunity. It might not be advisable from a public relations standpoint, but it is not subject to being successfully sued for damages.
